2012 presents one of the most important years in the history of the corporate retirement plan. In July, the Department of Labor's (DOL) new regulations numbered 408(b)(2) and 404(a)(5) will have a large impact on retirement plan vendors – how they must structure their fees, how and what types of disclosures they will provide, and how their accountability will be altered. Retirement plan sponsors, however, are also inheriting a massive change in their fiduciary role and responsibilities. The new DOL rules will impact plan sponsors equally, if not more than their service providers, and will require an overhaul of the plan sponsor's approach to their fiduciary activities. Companies sponsoring 401(k) plans have long been responsible for ensuring that fees are reasonable. Yet the amounts of these fees haven't been easily accessible to employers or employees -- until now.

    Mr. Maloney was a member of the Board of Directors of the Foundation for Fiduciary Studies and was appointed by the U.S. House of Representatives and Senate as a member of the Industry Sector Working Group on Financial Services. He is an instructor in trust and securities law at Boston University School of Law, has been a visiting instructor at the Federal Financial Institutions Examination Council and the American Bankers Association's National Graduate Trust School at Northwestern University, and participates in programs leading to the designation of Certified Trust and Financial Advisor. Mr. Maloney has also served as an expert witness in both judicial and legislative settings on matters relating to fiduciary compensation, will construction, and prudent investing.

    John Tousley, CFA, is a senior strategist within GSAM’s Third Party Distribution Portfolio Strategy Group where he co-leads a team of specialists focused on economic and market strategy as well as client engagement on advanced portfolio construction and implementation issues. John has been with the firm 11 years. Prior to joining the Portfolio Strategy Group, he was member of the GSAM fixed income portfolio management team with a specific focus on municipal, short duration, and multi-sector fixed income coverage. John was named managing director in 2011. He has 20 years of industry experience as an investment professional and portfolio manager. John received a B.A. in Economics from Brigham Young University in 1991 and is a CFA charter holder.
